Sales Term and Conditions
The following articles constitute the Sales Terms and Conditions in force on ArtMeNow! website.
1. Preamble
The website www.artmenow-gallery.com is managed by Gianmarco Capitanio, domiciled at 1 rue Castex, 75004 Paris (RCS Paris n. 822 691 911).
2. Legal Notice
2.1. These general conditions of sale define the terms of sale between Gianmarco Capitanio (hereinafter “ArtMeNow!”) and any person (hereinafter “the Customer”) who makes a purchase via the website www.artmenow-gallery.com ( hereinafter “the Website”).
2.2. Any order placed on the Website constitutes the formation of a contract, concluded at distance, between ArtMeNow! and the Client. It implies full acceptance by the Customer, without any restriction or reservation, of these general conditions of sale.
2.3. The Customer declares to be at least 18 years old and to have the legal capacity or to be the holder of a parental authorization allowing him to place an order on the Website.
3. Order taking
3.1. The Customer can place an order on the Website.
3.2. Any order implies acceptance by the Customer of the prices and descriptions of the products available for sale, as well as of these Sales Terms and Conditions.
3.3. Once the order has been finalized, ArtMeNow! sends a confirmation email to Customer’s mail address associated with the payment method (email address associated with PayPal account or address provided to ArtMeNow!).
3.4. The transfer of ownership is effective after payment and at the end of the withdrawal period.
3.5. ArtMeNow! holds the right not to record a payment, and not to confirm an order for any reason, until the transfer of ownership.
3.6. ArtMeNow will refund the Customer for any payment made for a canceled order.
4. Prices
4.1. ArtMeNow! holds the right to change items prices at any time. The prices invoiced are those in force at the time of registration of the order.
4.2. The prices are indicated in Euros, all taxes included, excluding shipping costs, indicated separately in the order. ArtMeNow! being a microenterprise, VAT is not applicable.
4.3. For deliveries outside mainland France, customs fees and local taxes are the responsibility of the Customer.
5. Billing and payment
5.1. Payments can be made via Paypal or by bank transfer. In case of payment by bank transfer, the bank details of ArtMeNow! will be provided by email to the Customer.
5.2. ArtMeNow will send the product invoice with each order.
5.3. The Customer guarantees ArtMeNow! that he/she has the necessary authorizations to use the payment method chosen during the validation of the order.
5.4. The transfer of risks is effective upon receipt of payment. ArtMeNow! offers insurance concerning the risks linked to transport.
5.5. Shipping costs depend on the nature of the order and on the delivery zone. The costs are displayed during the validation of the order.
6. Delivery
6.1. The Customer is responsible for the accuracy of the informations provided for delivery. These data are transmitted to ArtMeNow! via the Customer’s PayPal account or by e-mail by the Customer himself.
6.2. In the event of a Customer error on the delivery details, ArtMeNow! cannot be held responsible for any delays in delivery. The additional costs linked to such an error will be borne by the Customer.
6.3. Upon receipt and confirmation of payment, the order will be prepared as soon as possible (at most 10 working days after receipt of payment). In case of delay, the Customer will be notified and will have the possibility to cancel the order.
6.4. Once prepared, ArtMeNow will send the order to the Customer via a professional delivery service. ArtMeNow will communicate proof of sending and parcel tracking numbers to the Customer by e-mail.
6.5. ArtMeNow! is not responsible for the delay of the parcels entrusted to the deliverers.
6.6. The condition of the parcels must always be checked upon receipt. The content of the order travels at the risk of the customer. ArtMeNow! cannot be held responsible for damage to articles and their packaging during delivery.
6.7. If the parcel is damaged, the Customer should refuse the package. ArtMeNow! agrees to refund the Customer for the full amount of the item. If the Customer does not refuse the damaged parcel, it is up to him to bring the usage reserves to the Deliverer. If the Customer has accepted the package without reservations, in no case may he/she demand reimbursement of the price of the damaged product or of the delivery fee.
7. Cancellation and Returns
7.1. In application of article L.121-16 of the Consumer Code, the Customer has a withdrawal period of 14 days from the date of receipt of the order.
7.2. The Customer undertakes to prevent ArtMeNow! of the return of the order, and return it in its original packaging. Shipping costs are the responsibility of the Customer.
7.3. If the return order is in the same condition as when it was sent, ArtMeNow! agrees to reimburse the price of the order (including shipping costs) within 3 weeks.
8. Jurisdiction
8.1. The contractual provisions defined in these General Sales Conditions are governed by French law.
8.2. The Customer undertakes to contact ArtMeNow first! to resolve any dispute amicably.
8.3. In the absence of an amicable solution, the French courts will have sole jurisdiction.
9. Personal data
9.1. ArtMeNow! reserves the right to collect nominative information and personal data concerning the Customer. They are necessary for the management of your order, as well as for the improvement of the services and information provided by the Website.
9.2. They can also be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
9.3. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
9.4. In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and personal data concerning you, directly on the website.
10. Proof Archiving
10.1. ArtMeNow! will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
